Terms of Service

1. Acceptance of Terms

By accessing or using TravWiz ("Service"), operated by TravWiz AI Inc. ("Company", "we", "us", or "our"), you agree to be bound by these Terms of Service ("Terms"). By signing in to our Service, you automatically agree to these Terms. If you do not agree to these Terms, you may not access or use our Service.

2. Geographic Restrictions

TravWiz is currently not available to users located in the European Union or other GDPR-protected regions. By using our Service, you confirm that you are not accessing it from a restricted region.

We reserve the right to terminate or suspend access for users who access the Service from restricted regions. This restriction may be modified in the future as we expand our compliance capabilities.

3. Description of Service

TravWiz is an AI-powered travel planning platform that helps users create personalized travel itineraries. Our Service includes:

  • AI-generated trip plans and day-by-day itineraries
  • Destination and activity recommendations
  • Trip customization and planning tools
  • Multi-city trip planning and management
  • Travel booking affiliate services through partner platforms
  • Trip sharing and social features

4. User Accounts and Authentication

To access certain features of our Service, you must create an account. You must be at least 13 years old to use this Service. We support authentication through:

  • Google OAuth
  • Apple Sign-In
  • Facebook Login
  • Discord Authentication

You agree to:

  • Provide accurate and complete information during registration
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized use of your account
  • Accept responsibility for all activities under your account

5. Subscription Tiers and Features

Our Service operates on a freemium subscription model with multiple tiers:

  • BASIC Tier: Limited trip favorites (up to 10), view-only access to saved trips
  • SMART Tier: Enhanced features including trip customization and increased favorites (up to 100)
  • GENIE Tier: Unlimited features including unlimited favorites and advanced customization

Subscription features and limitations are subject to change. We will provide reasonable notice of any material changes to subscription benefits.

6. User Conduct

You agree not to use the Service to:

  • Violate any applicable laws or regulations
  • Infringe on the rights of others
  • Transmit harmful, offensive, or inappropriate content
  • Attempt to gain unauthorized access to our systems
  • Use automated tools to access or scrape our Service
  • Interfere with or disrupt the Service or servers
  • Upload or share content that violates our community guidelines

7. User Content and Profile Information

When you use our Service, you may provide certain content and information, including profile pictures and other user-generated content.

Profile Pictures

By uploading a profile picture to TravWiz, you acknowledge and agree that:

  • Profile pictures are publicly accessible and may be viewed by other users and visitors to our Service
  • You grant us a non-exclusive, worldwide, royalty-free license to store, display, and distribute your profile picture as part of the Service
  • You are solely responsible for the content of your profile picture and must ensure it does not violate any laws or third party rights
  • Profile pictures must not contain offensive, inappropriate, or illegal content
  • We reserve the right to remove any profile picture that violates these Terms or our community guidelines
  • Profile pictures are limited to 5MB in file size

You retain ownership of your profile picture, but you are responsible for maintaining your own backups. We are not liable for any loss or corruption of user content.

8. Payment and Billing

For paid subscription tiers, the following terms apply:

  • All fees are charged in U.S. dollars unless otherwise stated
  • Subscription fees are billed in advance on a recurring basis
  • You authorize us to charge your payment method for applicable fees
  • All payments are non-refundable except as required by applicable law
  • Payments made are non-refundable and will remain valid until the end of your subscription period. No refunds will be provided for cancellations made during a subscription period
  • We reserve the right to modify subscription pricing with at least 30 days' notice

Credits and Rewards

  • Credits or rewards granted through promotions, referrals, or other programs have no monetary value and are non-transferable
  • Promotional credits expire 90 days from the date of grant unless otherwise stated at the time of issuance
  • Credits can only be redeemed during their valid period and cannot be exchanged for cash or other consideration
  • We reserve the right to modify, suspend, or terminate credit programs at any time

9. Intellectual Property

The Service and its content, including but not limited to text, graphics, logos, and software, are owned by TravWiz AI Inc. and protected by intellectual property laws. You may not:

  • Copy, modify, or distribute our content without permission
  • Use our trademarks or branding without authorization
  • Reverse engineer or attempt to extract source code
  • Create derivative works based on our Service

10. Third-Party Services and Affiliate Partnerships

Our Service integrates with various third-party services and affiliate partners, including:

  • Booking platforms (such as Booking.com)
  • Social media platforms (Instagram, TikTok, Facebook, Discord)
  • Mapping and location services
  • Payment processing services

We are not responsible for the availability, content, policies, or practices of these third-party services. When you make bookings through our affiliate partners, you are subject to their respective terms and conditions.

Booking Services Disclaimer

IMPORTANT: TravWiz is a travel recommendation and planning platform, not a travel agency or booking service provider. We do not book, sell, or directly provide any travel services including flights, hotels, tours, or activities.

  • All bookings are made directly with third-party providers through their platforms
  • We have no control over and assume no liability for the accuracy of pricing, availability, or quality of third-party services
  • We are not responsible for any issues, cancellations, changes, or disputes related to bookings made through third-party providers
  • You are solely responsible for verifying all booking details, travel requirements, and making your own travel arrangements
  • Any booking links provided are for convenience only and may generate affiliate commissions

11. Privacy and Data Protection

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your information. By using our Service, you consent to the collection and use of your data as described in our Privacy Policy.

12. Content and User-Generated Content

Users may create, upload, or share content through our Service. By submitting content, you:

  • Grant us a worldwide, non-exclusive license to use, display, and distribute your content
  • Represent that you have the right to share the content
  • Agree not to submit content that infringes on others' rights
  • Understand that we may remove content that violates these Terms

Use of Trip Data for Curated Content

By creating trips, customizing itineraries, or voting on content within TravWiz, you acknowledge and agree that:

  • We may use trips, itineraries, destinations, and activities you generate to create and publish "Curated Trips" that are made available to other users
  • This usage is limited to travel-related data only and does not include any personal information that can identify you
  • All published curated content is completely anonymous with no attribution to individual users
  • Anonymized engagement metrics (such as vote counts and customization counts) will be displayed to other users to help them discover popular trips and activities
  • These metrics cannot be traced back to individual users and serve only to show aggregate popularity

13. Disclaimers

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Travel recommendations are for informational purposes only. You are responsible for:

  • Verifying travel requirements, restrictions, and safety conditions
  • Making your own travel bookings and arrangements
  • Ensuring your safety and compliance with local laws
  • Confirming accuracy of activity details, pricing, and availability

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRAVWIZ AI INC. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THE SERVICE, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, DATA, OR OTHER INTANGIBLE LOSSES.

15. Termination

We may terminate or suspend your account at any time for violation of these Terms or for any other reason, with or without notice. You may also terminate your account at any time by contacting us or through account settings. Upon termination, your right to use the Service ceases immediately.

16. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to our website. Your continued use of the Service constitutes acceptance of the modified Terms. We will notify users of material changes via in-app notification.

17. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of Delaware, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the Service will be resolved through binding arbitration in Delaware.
